Pacific Herbs Minimum Advertised Price (MAP) Policy
The policy outlined here is the unilateral will of Pacific Herbs and can be amended at any time without prior notice. Such amendments will be communicated via mail and/or email to all involved stakeholders. This policy serves to protect the investment made by practitioner-retailer-customers by ensuring profitability in the marketplace.
The Minimum Advertised Price (MAP) governs the resale of products from Pacific Herbs, a distributor of practitioner and natural health care supplements and natural health care products. The Minimum Advertised Price is the price set for each Pacific Herbs product currently available on our website and order form. The Minimum Advertised Price for each product is not subject to negotiation with any Pacific Herbs practitioner-retailer-customers.
The MAP policy applies to the advertised price of every Pacific Herbs product in any and all media including but not limited to: flyers, coupons, emails, posters, inserts, newspapers, magazines, catalogs, direct mail, Internet, ecommerce, television, and radio.
All practitioner-retailer-customers purchasing Pacific Herbs products for the purposes of reselling must be officially qualified, authorized and licensed practitioner-retailer-customers. This policy applies to all practitioner-retailer-customers purchasing directly from Pacific Herbs or through an authorized distributor. Pacific Herbs practitioner-retailer-customers agree to assume all liability and responsibility for the resale of products through the internet.
If a practitioner-retailer-customer fails to comply with the MAP policy, an Pacific Herbs Representative will notify the practitioner-retailer-customer via telephone or email of the violation. A suspension may be placed on the practitioner-retailer-customer’s account until the “in violation” pricing has come into compliance.
If a practitioner-retailer-customer repeatedly violates the MAP policy, Pacific Herbs reserves the right to permanently revoke the practitioner-retailer-customer’s wholesale purchasing privileges. Pacific Herbs, reserves the right to terminate the practitioner-retailer-customer’s account, in particular instances. A violation of Pacific Herbs MAP policy will almost always result in the suspension of the practitioner-retailer-customer’s account. Pacific Herbs reserves the right to discontinue selling any of its products to any customer who is affiliated with a website that is violating this MAP policy.
Prices may not be concealed below MAP in internet shopping carts by using click-through practices, such as “too low to show” or “add to cart to view price.” Prices listed in the Pacific Herbs order forms may never be advertised on internet auction sites such as eBay, Amazon, Beezid, Grabcart, Overstock, or classified ad sites such as Craigslist. If products appear on third party websites from untraceable sources, third party sites are obligated to adhere to the provisions of this policy. This prohibition includes, but is not limited to Amazon, eBay, and similar outlets.
International Restrictions: Products are for distribution in the Canada or United States only. Due to international supplement regulations and policies governing such products, and to protect the integrity and rights of our international distributors, products cannot be shipped internationally.
This policy prohibits the advertising of any volume discount or other promotion that would cause the per unit sales price to be advertised at less than the Pacific Herbs MAP policy. This does not apply to advertising within a practitioner or natural health retailer’s office or store setting. The “practitioner or natural health retailer’s office or store setting” is defined as the physical location where patients or customers are medically seen and treated by the licensed health care practitioner, or in store, as approved by Pacific Herbs.
